The Town of Pompey Zoning Board of Appeals held their regular monthly meeting on Monday, October 9, 2023 at 7pm. A video of the full meeting can be viewed on the Town of Pompey Facebook Page.
Highlights of the meeting are as follows:
Harrington Homes Area Variance
Resuming their previous month’s discussion on a requested variance from property owner Harrington Homes, Town attorney Tim Frateschi shared with the public that, because a subdivision application from 1986 was never filed with the County, approval of that subdivision was nullified and, therefore, there is no way to approve the requested variance since there is no existing legal subdivision. Frateschi further stated that Harrington has withdrawn their application for the variance. If Harrington chooses to pursue a new subdivision, they must approach the Town Planning Board with that request.
Public Hearing on 4504 Spruce Ridge Road Area Variance
The ZBA held a public hearing to receive comments on a request by Town of Pompey resident Dan Cech for an area variance for a roof mounted solar system in a residential district. He requested an increase of 15.5 kW above the permitted 25kW for a total to 40k to be mounted on the roof of an existing barn on the property.
Several members of the public spoke in favor of the project. There were no comments opposing the variance.
The ZBA reviewed the standard 5 criteria to determine the impact on the community and, after determining that there would be little-to-no impact, the ZBA voted unanimously to approve the variance.
